Class 4 Felony

Types of Crime Classified as Class 4 Felonies

Crimes considered Class 4 felonies include many of the least serious felony crimes. The following crimes, found in the Illinois Criminal Code, are examples of Class 4 felonies:

  • Theft of government property worth less than $500;
  • Possession 30 to 500 grams of marijuana;
  • Aggravated assault;
  • Stalking; and
  • Hate crimes.

Sentences for Class 4 Felony Convictions

Under Illinois sentencing law, Class 4 felonies carry sentences of between 1 and 3 years in prison. In addition, an extended term Class 4 felony will carry a sentence of 3 to 6 years in prison. Extended terms can be imposed if aggravating factors exist, such as prior criminal convictions, the nature of the alleged crime as a hate crime, or the presence of a victim over age 60 (730 Ill. Comp. Stat. § 5/5-4.5-45.)

Class 4 felonies are generally eligible for some alternative sentencing options, including periodic imprisonment, impact incarceration, probation for several years, and conditional discharge for several years. However, there are some exceptions that cannot qualify for probation. Check with an experienced felony defense attorney to find out if your case might qualify.
