Class 2 Felony

If you have been charged with a felony crime in Illinois, a Chicago-area criminal defense lawyer can help you devise an aggressive defense. Goldman & Associates will fight to protect your rights throughout the criminal trial process.

Types of Crime Classified as Class 2 Felonies

Crimes considered Class 2 felonies include many serious crimes. The following crimes, found in the Illinois Criminal Code, are examples of Class 2 felonies:

  • Possession of 2,000 to 50,000 grams of marijuana;
  • Defacement of school property causing over $300 in damage;
  • Theft of 2,000 to $10,000;
  • Receiving stolen property worth $10,000 to $100,000; and
  • Robbery .

This is not an exhaustive list, but merely represents some common Class 2 felonies. If you are unsure of whether any of the charges that have been brought against you would count as a Class 2 felony, check with a knowledgeable defense attorney.

Sentences for Class 2 Felony Convictions

Under Illinois sentencing law, Class 3 felonies carry sentences of between 3 and 7 years in prison. In addition, an extended term Class 2 felony will carry a sentence of 7 to 14 years in prison. Extended terms can be imposed if aggravating factors exist, such as prior criminal convictions, the nature of the alleged crime as a hate crime, or the presence of a victim over age 60 (730 Ill. Comp. Stat. § 5/5-4.5-35.)

Class 2 felonies are generally eligible for some alternative sentencing options, including periodic imprisonment, impact incarceration, probation for several years, and conditional discharge for several years. However, there are some exceptions that cannot qualify for probation. Check with an experienced felony defense attorney to find out if your case might qualify.

On top of prison time, courts can impose substantial fines for Class 2 felonies, and you can be forced to pay restitution fees to alleged victims for any financial losses that they may have suffered.
